Your account without a purchase: terms of use, information and Right of Withdrawal<\/p>\n

Applies if you register directly on the website without paying a support contribution<\/p>\n

\u00a7 1 Scope and contracting parties<\/h2>\n

(1) These provisions apply if you register your own account via the website www.h-oursapp.com without paying a support contribution (Part A<\/a>) in doing so.<\/p>\n

(2) The contracting parties are exclusively you and mehr wollen UG (haftungsbeschr\u00e4nkt), Industriestra\u00dfe 15, 18069 Rostock (hereinafter \u201cwe\u201d or \u201cus\u201d).<\/p>\n

(3) Consumers and traders are to be understood within the meaning of \u00a7\u00a7 13, 14 BGB (see Part A<\/a> \u00a7 1 (3)). The offering is aimed exclusively at persons resident or established in Germany (see Part A<\/a> \u00a7 1 (5)).<\/p>\n<\/section>\n

\n

\u00a7 2 Registration and conclusion of contract<\/h2>\n

(1) The following details are required for registration: email address, password and user name. The registration process is confirmed by double opt-in: you receive an email with a confirmation link, and the registration only takes effect when you click it.<\/p>\n

(2) The contract about the use of the account is concluded at the moment you complete the registration.<\/p>\n

(3) Your account receives a user ID for unambiguous assignment.<\/p>\n

(4) If you later make a purchase via your account, the respective GTC (Part A)<\/a>additionally apply to that purchase; this does not change this registration and this contract.<\/p>\n<\/section>\n

\n

\u00a7 3 Legal classification<\/h2>\n

(1) No sum of money is paid for the registration.<\/p>\n

(2) As a precaution we treat this account as a separate contract about digital content (\u00a7 327 (3) BGB) in which personal data is processed as consideration; you therefore have the same consumer protection rights as under a paid contract.<\/p>\n<\/section>\n

\n

\u00a7 4 Obligations when using the account<\/h2>\n

(1) You provide truthful information when registering and only create one account for yourself.<\/p>\n

(2) Your access data is personal. You do not pass it on to third parties and keep it in such a way that third parties have no access to it. If you suspect that someone else has access to your account, please let us know.<\/p>\n

(3) One account is created per person. Multiple accounts of the same person are merged or deleted by us.<\/p>\n

(4) You do not use the account to harm others, to breach applicable law or to impair the technical function of our offerings.<\/p>\n<\/section>\n

\n

\u00a7 5 Termination and deletion of the account<\/h2>\n

(1) You may terminate this contract at any time without notice period \u2014 via the settings of your account or with an informal message to info@h-oursapp.com. We will then delete your account without undue delay, unless statutory retention obligations prevent this.<\/p>\n

(2) Your statutory right of withdrawal (see below) remains unaffected by a termination and exists independently of it.<\/p>\n

(3) We may terminate this contract for good cause without notice period, in particular in the event of a serious or repeated breach of \u00a7 4. Before terminating we will point out the breach to you and give you the opportunity to remedy it, to the extent this is reasonable in the circumstances.<\/p>\n<\/section>\n

\n

\u00a7 6 Liability<\/h2>\n

(1) We are liable without limitation for damage arising from injury to life, body or health, and for damage based on an intentional or grossly negligent breach of duty by us, our legal representatives or our vicarious agents.<\/p>\n

(2) In the case of a slightly negligent breach of a material contractual obligation (cardinal obligation) whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely, our liability is limited to the foreseeable damage typical for this type of contract.<\/p>\n

(3) In all other respects, liability for damage caused by slight negligence is excluded.<\/p>\n<\/section>\n

\u00a7 7 Final provisions<\/h2>\n

(1) The law of the Federal Republic of Germany applies. If you act as a consumer with your habitual residence abroad, the protection of mandatory provisions of the state of your habitual residence remains unaffected.<\/p>\n

(2) We are neither obliged nor willing to take part in a dispute resolution procedure before a consumer arbitration body.<\/p>\n

(3) Should individual provisions of this Part I be or become wholly or partly invalid, this does not affect the validity of the remaining provisions.<\/p>\n<\/section>\n

What you get.<\/strong> The account currently offers no function of its own beyond the mere registration; it is being prepared for a later purchase or for the launch of shop and app.<\/p>\n

What you pay for it.<\/strong> You pay no sum of money for the registration. Personal data is however processed as consideration (\u00a7 327 (3) BGB). You therefore have the same consumer protection rights as under a paid contract \u2014 including the right of withdrawal below.<\/p>\n

When the contract comes into existence.<\/strong> At the moment you complete the registration. You receive this information before that moment.<\/p>\n

How you receive this information.<\/strong> Before completing the registration you tick a checkbox confirming that you have read the pre-contractual information and the Right of Withdrawal; the link to the full text is embedded in the text of the checkbox. Immediately after successful registration you additionally receive an automated confirmation email with the full text \u2014 pre-contractual information, Right of Withdrawal and model withdrawal form \u2014 as a PDF attachment.<\/p>\n<\/section>\n

Right of Withdrawal<\/h2>\n

You have the right to withdraw from the contract for the use of your account within fourteen days without giving any reason.<\/p>\n

The withdrawal period is fourteen days from the day of registration, that is the day on which you concluded the contract about your account.<\/p>\n

To exercise your right of withdrawal, you must inform us (mehr wollen UG (haftungsbeschr\u00e4nkt), Industriestra\u00dfe 15, 18069 Rostock, Germany, email: widerruf@h-oursapp.com) of your decision to withdraw from this contract by means of an unequivocal statement. You may use the attached model withdrawal form, but it is not obligatory.<\/p>\n

You may also exercise your right of withdrawal online via the withdrawal function permanently provided on our website at https:\/\/www.h-oursapp.com\/vertrag-widerrufen<\/a> can be exercised. Enter your user ID in the field \u201cWhich contract?\u201d there (\u00a7 2 (3)); it is shown in your account under \u201cYour user ID\u201d. If you use this online function, we will send you an acknowledgement of receipt on a durable medium, e.g. by email, without undue delay, containing the content of your declaration as well as the date and time of receipt.<\/p>\n

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.<\/p>\n

Effects of withdrawal<\/h3>\n

As no monetary payment was made for this contract, no refund takes place. We delete your account and the personal data processed in connection with it without undue delay, unless statutory retention obligations prevent this.<\/p>\n

If you have in the meantime already made a purchase via your account, that separately concluded contract remains unaffected by a withdrawal of the registration. In that case we cannot delete your account completely straight away, because we are legally required to retain the data relating to your purchase. We will then contact you and agree with you what can be deleted and what must remain until the retention period expires. Your withdrawal remains unaffected by this.<\/p>\n
